Blind Podiatrist Loses Suit Over Removal From Marijuana Program

A blind New Jersey podiatrist can’t proceed with claims alleging he was improperly removed from the state’s medical marijuana program based on his disability, because he wasn’t otherwise qualified to participate, a federal court in the state said.

A health-care provider must be a “physician” under the state medical marijuana law to qualify for the program allowing them to refer patients for medical marijuana treatment, the U.S. District Court for the District of New Jersey said.

A podiatrist doesn’t qualify under the definition contained in the Compassionate Use of Medical Marijuana Act, the court said.
