Brazil: Ministry of Agriculture confirms regulation of hemp cultivation until May 19.. “According To A Source!”

Because of much anxiety for the cannabis sector, the regulation of hemp cultivation will be published until May 19, a member of the Ministry of Agriculture and Livestock (MAPA) confirmed to the Sechat Portal.  

According to the source, the regulatory process is in the final phase, leaving only “internal formalizations”. Agriculture Minister Carlos Favaro is on an official mission in Luanda, the capital of Angola, and is expected to return to Brazil in the coming days to “hammer” on the final text of the regulation.

In addition to MAPA, Anvisa and the Ministry of Health participate in the regulatory process. The publication of an official note on the subject may occur even before the final disclosure of the regulation.

Deadline defined and maintained

On November 13, 2024, the First Section of the Superior Court of Justice (STJ) made a landmark decision to the authorize the granting of health authorization for the planting, cultivation and marketing of industrial hemp — Cannabis sativa variety with tetrahydrocannabinol (THC) content less than 0.3% — by legal entities, for exclusively medicinal and pharmaceutical purposes.

The decision was issued in the context of the Incident of Assumption of Competence (IAC 16) and established a period of six months for regulation, which ends at the beginning of May 2025.

The Advocacy-General of the Union (AGU) requested an extension of the deadline to 12 months, stating that the guidance is complex and requires more time for analysis. However, in a new session, held in February 2025, the STJ it maintained the deadline for delivery of the regulation on May 19.
