Delaware: New bill would regulate THC-infused drinks like alcohol

If you want to grab a THC-infused drink from a Delaware bar, now is the time to do so because you might not be able to this summer.

A new House bill would limit these beverages to package stores exclusively. The bill is out of committee, and its sponsor, Rep. Debra Heffernan, a Democrat from Bellefonte, is confident this will be signed into law by the time the current legislative session wraps up.

House Bill 98 would impact the state’s alcohol supply chain. It would remove THC-infused beverages from their current regulatory gray area and install them into the three-tier alcohol supply chain. That chain is an insular and crowded path from producer to distributor and into package stores.

In essence, the legislation streamlines the THC-infused beverages to be sold at package stores.

The bill would also require that “consumable hemp products,” which mainly apply to vapes and edible marijuana products like gummies, only be sold in marijuana retail stores, which do not exist yet.
