Deputy County Counsel III-V Stanislaus County CA

County Counsel is interested in candidates with a basic understanding of and demonstrated interest in land use law, including, for example, one or more of the following: the California Environmental Quality Act (CEQA), local implementation of State Planning and Zoning Law, Cannabis regulation, Affordable housing laws, as well as other land use and environmental laws such as the Subdivision Map Act, Clean Water Act, and Williamson Act. Land Use attorneys work closely with the Board of Supervisors, Planning Commission, and staff to review public and private development projects. They may also be responsible for defending the County’s land use decisions and enforcing the County Code in state and federal court.

THE POSITION

Assigned to the Land Use Practice Group, the duties of the position may include advising code enforcement officers and litigating code enforcement actions; serving as a legal advisor to County departments, boards, and commissions involved in land use matters, including advising staff and decision makers on local, state, and federal laws pertinent to processing and action on private land use entitlements; advising on development and implementation of planning initiatives, including specific plans and update of the general plan; attending meetings of boards and commissions; drafting legislation, ordinances, resolutions, contracts, and other legal documents; advising on core government laws including the Brown Act, Public Records Act, and Political Reform Act; serving as a resource for or in assistance to the County Counsel, Assistant County Counsel, or other practice groups in need of consultation with land use counsel; and defending actions against the County and its subdivisions.
Unless otherwise provided, this position is part of the Unclassified Service of the County and considered “at will” for labor relations purposes. The individual selected will participate in the Stanislaus County Pay-for-Performance program, as well as receive additional benefits.

Minimum Qualifications (Skills, Ability, Knowledge, Education/Experience)

 

SKILLS/ABILITIES
  • Perform highly complex legal research work;
  • Analyze and apply legal principles and precedents to legal problems;
  • Present statement of fact, law, and arguments clearly and logically;
  • Draft ordinances, resolutions, and regulations;
  • Propose legislative measures; and
  • Travel to local, State and Federal Courts .

KNOWLEDGE
  • Legal principles and their application;
  • Legal research methods;
  • Principles of administrative and public law; and
  • Duties, powers, limitations, and authority of the County Counsel’ s Office.

EDUCATION/EXPERIENCE
DEPUTY COUNTY COUNSEL III
  • Three (3) years of experience as a Deputy County Counsel or the equivalent legal experience in public or private services; AND
  • Additional experience is needed in at least one (1) of the following areas: public, civil, labor and employment, or contract law.

DEPUTY COUNTY COUNSEL IV
  • Four (4) years of experience as a Deputy County Counsel or the equivalent legal experience in public or private services ; AND
  • Additional experience is needed in at least one (1) of the following areas: public, civil, labor and employment, or contract law.

DEPUTY COUNTY COUNSEL V
  • Five (5) years of experience as a Deputy County Counsel or the equivalent legal experience in public or private services; AND
  • Additional experience is needed in at least one (1) of the following areas: public, civil, labor and employment, or contract law.

LICENSE

  • The individual selected must be an active member of the California State Bar at the time of appointment. The Bar membership must be listed at the appropriate section on the application form. Possession of an active, valid membership in the California State Bar is evidence of sufficient education for this classification.

DESIRABLE QUALIFICATIONS

  • Experience in one or more of the following specialized areas of law: public works and construction, land use, public contracting, finance, property taxation, elections, transportation (including roads and airports), affordable housing, land use development, real property, the California Environmental Quality Act (CEQA), tax and finance, ethics and conflicts of interest.

EXAMINATION PROCESS

  • Written Examination. Applicants will be invited to participate in a written exam that tests knowledge for the position.
  • Oral Examination. Applicants are invited to a panel interview in which they will be evaluated by County subject matter experts.
  • Eligible Lists. Candidates who pass the examination will be placed on an eligible list for that classification. Eligible lists are effective for six months, but may be extended up to eighteen months.
