The Düsseldorf tax court has ordered the main customs office in Bielefeld to grant Weedo tax stamps for herbal cigarettes made from hemp flowers/CBD flowers (we reported). According to Ferdinand Weiss, cannabis lawyer at the law firm Dr. Engelhard, Weimar & Kollegen, the ruling is significant as it goes against the opinion of federal authorities who classify such products as narcotics and deny their taxability. This decision could have far-reaching implications for the prosecution of CBD traders, as tax marks act as a seal of marketability and can thus avert criminal prosecution. However, the ruling is not yet legally binding, as the customs authorities have lodged an appeal. The proceedings will continue.
