Regulating Alternative Means of Consumption Panel

The consumption of cannabis via non-combustive means is becoming increasingly common and a preferred form of administration for many patients and consumers. Innovative delivery systems are being developed and adopted in the marketplace at an unprecedented pace. This panel will address current and emerging challenges surrounding such methods and new products from business, legal, and regulatory perspectives. Topics will include the vaping crisis, regulation of novel delivery systems, hardware inputs and related supply chain matters, various approaches to the regulation of edibles, hemp and hemp-derived CBD, and what the future may hold.

Cannabis Appellations of Origin

On April 2, 2020, INCBA presented a comprehensive symposium on Appellations of Origin, in conjunction with the UC Berkeley School of Law Cannabis Society. At the symposium, we discussed, among other things, well-established appellations designations for products such as wine and cheese as a subset of geographic indications, as well at the California Department of Food & Agriculture’s proposed regulations on establishing cannabis appellations in California, the first program of its kind in the world.

Join us for an update – from the comments that INCBA has submitted to the CDFA on behalf of the industry, to the most important aspects of the regulations, and what is necessary to make appellations of origin a functional tool for consumer education and choice in the cannabis industry.

Hemp – USDA Interim Final Rule and What it Means for Hemp Clients

In October 2019, USDA published its Interim Final Rule (“IFR”) implementing the hemp provisions of the 2018 Farm Bill. Many industry experts worry that the IFR makes it practically, legally, and scientifically impossible to cultivate hemp for CBD. This panel seeks to get to the bottom of the IFR and what it means for the hemp CBD industry currently and in the future. We may also touch on the intersection of USDA and FDA authority to regulate hemp-derived CBD products.
