Italy: Lazio Regional Administrative Court suspends the MoH Decree on drugs based on cannabidiol obtained from cannabis extracts

The Regional Administrative Court of Lazio – Rome, with its Order No. 4234 of 11 September 2024, ruled the suspension of the Decree of the Ministry of Health dated 27 June 2024, according to which the compositions for oral administration of cannabidiol obtained from Cannabis extracts are included among the narcotic drugs in Section B, i.e., the table of drugs containing psychotropic or narcotic substances.

That decree effectively banned the sale of cannabis extract in stores, herbalist stores and tobacconists, limiting it to pharmacies and only with a non-repeatable medical prescription.

This way, the administrative judge granted the precautionary petition filed by ICI, Imprenditori Canapa Italia (Italian Hemp Entrepreneurs), highlighting “the peculiarity of the matter under dispute” and the “implications involving an entire supply chain ranging from the production to the marketing of products containing cannabis extracts”.

The hearing on the merits of the case will take place on 16 December 2024.
