The Supreme Court of Justice of the Nation (SCJN) ordered the Health Secretariat and to the Cofepris issue, within a period of 180 days, the regulation indicating the procedure for marketing, export e import of products cannabis derivatives in concentrations of 1% or less of THC, as ordered in article 245 of the General Health Law.
Second Chamber ministers analyzed the company case Cannabis Energy Drink Mexico, who disagreed with deny an amparo to import and market four types of energy drinks containing less than 1% hemp extract.
The company alleged that derived from that omission, its right to freedom of work, since the Law establishes that products that contain cannabis derivatives in concentrations of 1% or less THC, must comply with “ the requirements established in the health regulation ”, regulations that should have been issued from the year 2017.
¿What’s next in this process?
The Minister Luis María Aguilar Morales proposed to the members of the Chamber to order the authority to issue the regulations and in case it does not happen, said authority would be linked to issuing a favorable response to the company.
He also proposed to instrument technical and scientific procedures essential for public communication and review of the content, ingredients, formula, packaging with which you must marketing and importing energy products.
During the session the minister was not Lenia Batres and the minister voted against Yasmin Esquivel Mossa.
