The Office of Marijuana Policy (OMP) recently issued a series of guidance memoranda related to a range of topics affecting the Adult Use Marijuana Program (AUMP).

Governor Mills Announces Changes to Moving Maine Forward Plan
Last week, Governor Janet T. Mills announced updates to the Moving Maine Forward Plan and the lifting of various COVID-19-related restrictions. These changes are effective May 24, 2021 and are summarized in the following communications.

Compliance Corner: Disposal of Marijuana Waste

In August 2020, OMP and the Maine Department of Environmental Protection (DEP) partnered to issue guidance on the proper disposal of marijuana waste.Additionally, the DEP has produced a reference document on managing marijuana waste which may prove useful to individuals and businesses engaged in cultivation of marijuana. One of the most effective ways to support recycling, beneficial reuse, and composting is to be proactive in how you segregate your marijuana waste. For establishments without on-site capacity, the DEP maintains information on licensed composting facilities: https://www.maine.gov/dep/waste/residuals/index.html.

Reminder: Mandatory Adult Use Metals Testing Forthcoming
Beginning on Tuesday, June 1, 2021, all adult use marijuana and marijuana products to be transferred from one licensee to another, as applicable, will be subject to mandatory testing for other harmful chemicals (metals) before such transfers may be completed. The requirement to include other harmful chemicals as a testing analyte is effective for all samples received by an adult use testing facility on or after June 1, 2021.

Beginning on that date, the six required analyte categories will be:

  1. Filth and foreign materials
  2. Dangerous molds and mildews
  3. Harmful microbes
  4. THC potency, homogeneity and cannabinoid profiles
  5. Water activity and moisture content
  6. Other harmful chemicals (metals, including cadmium, lead, arsenic, and mercury)

OMP first notified licensees of this change via guidance issued on April 1, 2021: Required Analyte Types for Mandatory Testing.

Adult Use Marijuana Program Licensing Update

Since our update in March, OMP has issued 21 active licenses to adult use establishments. These licenses have been issued to one marijuana testing facility, three products manufacturing facilities, three cultivation facilities, and 14 marijuana stores.

CATLAB is Maine’s third actively licensed adult use marijuana testing facility.
