Santa Monica City Attorney Announces Dismissals Of Marijuana Convictions

Santa Monica City Attorney Lane Dilg announced the completion of the 5 county “Clear My Record” pilot on Thursday, February 13. The pilot program has cleared marijuana related jail convictions eligible for relief under Proposition 64.

Proposition 64 declares the personal possession and use of marijuana as decriminalized. Under this proposition, adults 21 years of age and over may possess and grow specified amounts of marijuana for recreational use. Possession of recreational marijuana will still be a crime if in violation of one of the newly added Health and Safety Code Sections with penalties reduced.

“Pre-2016 cannabis possession convictions in Los Angeles County disproportionately impacted people of color — individuals, families, and communities,” said Santa Monica City Attorney Lane Dilg. “By working with the District Attorney to dismiss misdemeanor cannabis possession cases, the Santa Monica City Attorney’s Office joins offices across LA County in reducing barriers to housing and employment and continuing steps toward criminal justice policy that truly provides public safety for all.”

In California, all county District Attorney’s Offices are required to implement AB 1793 by July 1, 2020. Earlier this year, Code for America launched its new Clear My Record Application and Implementation Blueprint, available at no cost and open source to all California counties. These resources allow every District Attorney’s Office to expedite and streamline review of Proposition 64 convictions.

Prosecutors from the Los Angeles District Attorney’s Office requested that a Los Angeles Superior Court judge dismiss 62,000 felony cannabis convictions for cases that date back to 1961. They also requested that 4,000 misdemeanor cannabis possession from the cities of Los Angeles, Long Beach, Torrance, Pasadena, Inglewood, Burbank, Santa Monica, Hawthorne, Redondo Beach, and Hermosa Beach be dismissed.
