Colorado

Earlier this year, we worked closely with Colorado lawmakers and stakeholders for the enactment of SB 22-205. The task force established by the law has already held two meetings and will meet again on September 7. Based on what we’ve been told, task force members discussed whether and how to delineate between synthetic delta products and minor cannabinoids like CBN, THCV, and CBC—with a possible approach being prohibiting the former but not the latter. The task force has not yet considered how to determine intoxication levels or what intoxication thresholds will be. We will continue to monitor the task force’s meetings for developments.

Idaho

Last week, our friends at the National Animal Supplement Council (NASC) met with three members of the Idaho Department of Agriculture to address the Department’s plan to take enforcement action against hemp and hemp-derived animal feeds and remedies. According to NASC, discussions were promising and touched on the impact the action would have on the industry, economy, and animals, along with potential solutions for working with Idaho regulators and enforcement officials.

Virginia

The Virginia Board of Agriculture and Consumer Services’ final regulation for industrial hemp extracts intended for human consumption and foods containing an industrial hemp extract took effect on August 15. The final regulation establishes testing, approved source, and labeling requirements for consumable products and requirements for manufacturers.

Louisiana

Finally, Louisiana’s emergency rule on consumable hemp products has been published in the Louisiana Register. The rule classifies products with more than 0.5mg THC per package as “adult use” and sets a 8mg total THC per serving limit for consumable hemp products. The rule also establishes labeling and packaging requirements and sets limits for residual solvents and heavy metals.
