A California marijuana testing lab that had its license revoked last month was shot down on Friday by a state judge after requesting a court order mandating that its permit be reinstated.
California Cannabis Testing Lab, or CCTL, was denied its request for a temporary restraining order and a preliminary injunction against the state Department of Cannabis Control – the agency that revoked its license – when Alameda County Superior Court Judge Rebekah Evenson found on Friday that the state’s duty to protect public safety superseded the lab’s right to due process.
Evenson noted in her ruling that the DCC also granted a hearing to CCTL for an appeal on the denial of the company’s application for an annual license, though the license revoked was a provisional one and the decision was based on allegations of falsifying marijuana test results and a stream of other violations.
