DHV files constitutional complaint against Bavarian cannabis law
2025-07-30 | According to its own statement, the German Hemp Association (DHV) has initiated legal action against Bavaria’s special regulations on cannabis consumption, supported by patient René Korcak, consumer Emanuel Burghard, and pub owner Andreas Rothenberger. On 29.07.2025, the Bavarian Higher Administrative Court ruled that the ban in the northern part of Munich’s English Garden be temporarily lifted. Adults are therefore once again allowed to consume cannabis legally in this area, for now. The main proceedings for a full repeal of the consumption ban throughout the park are ongoing.
One day later, the DHV filed a constitutional complaint against the Bavarian Cannabis Consequences Limitation Act, which includes a blanket ban on consumption at public festivals and in outdoor areas of restaurants, according to a DHV press release.
Parallel to this, a lawsuit is pending before the Munich Administrative Court and a public action before the Bavarian Constitutional Court. From the perspective of the plaintiffs and the DHV, these regulations are unconstitutional and violate the fundamental rights of consumers, patients, and hospitality operators. The DHV criticizes Bavaria for effectively undermining the federally regulated partial legalization. Attorney David Werdermann views the Bavarian regulation as a disproportionate interference with civil liberties. DHV CEO Georg Wurth emphasizes that Bavaria should not create its own anti-cannabis laws based on ideology.
