The Transparency and Good Governance Council (CTBG) has given an important slap on the wrist to the Ministry of Health and, in particular, to the Spanish Agency for Medicines and Health Products (Aemps). In a recent resolution, the independent body has upheld the claim presented by the company Mifco Biobrands, SL. and he has urged the Aemps to provide detailed information about the cultivation licenses and production of cannabis for medicinal and scientific purposes.
The decision corrects the position maintained by the Medicines Agency, which until now had limited itself to publishing on its website a basic list of current authorizations, without going into the specific conditions of each license. The CTBG emphasizes that this information is public, is in the possession of the Administration and does not require «complex reworking», as the Ministry alleged to deny access.
A request beyond the official list
In February 2025, the company Mifco Biobrands submitted a request for access to information under the Transparency Law (Law 19/2013). His request was not limited to knowing which companies have authorization to grow medicinal cannabis, something that already appears on the Aemps portal. What he asked for was deeper: the specific conditions of the authorizations granted for research, production and validation of batches of active ingredients; information about germplasm banks, that is, collections of genetic material from the plant. They wanted to know which companies have them, whether they are their own or transferred, and for what purpose they were authorized; the origin of the starting materialused by authorized companies: if it comes from imports or national banks, and in the latter case, with what authorization it is supported.
