The Spanish Supreme Court has accepted the appeal filed by the Consejo General de Colegios de Farmacéuticos (CGCOF) last December. At issue is the government’s decision to limit the dispensing of medicinal cannabis products to hospital pharmacies only, as outlined in the new medicinal cannabis law (Royal Decree 903/2025 of October 7). The appeal does not have a suspensive effect, and the law will remain in force until a decision is reached.
The acceptance of the appeal was published in the Boletim General del Estado (BOE) on January 2nd, confirming the processing of the appeal in the Third Chamber of Administrative Litigation and giving a 9-day deadline for the necessary hearings – a deadline that expired this week.
As a source from CGCOF explained to CannaReporter®, “after the publication of this Royal Decree, the General Council decided to appeal to the Supreme Court, since, as we have argued throughout the entire process of drafting this Royal Decree, we consider that preventing pharmacies from dispensing these compounded formulas could be contrary to the Law of Guarantees and therefore illegal, since article 3.6 of said law stipulates that the dispensing of medicines must occur in pharmacies, except in very specific cases, which do not apply in this case.”
