Court ruling in Halle: Higher fine in trial over cannabis cuttings


2026-03-05 | The Regional Court of Halle sentenced activist and spokesperson of the Halle-Saalekreis local chapter of the German Hemp Association (DHV), Angelika Saidi, to a fine of €1,800 (50 daily rates) in an appeal proceeding, according to DubistHalle. The court thus significantly increased the previous ruling of the district court. The case concerned the seizure of 117 cuttings in July 2024, which the German Hemp Association had intended to distribute free of charge as part of a campaign. The public prosecutor classified the shoots planted in coconut substrate not as permitted propagation material but as full cannabis plants, possession of which in that quantity is illegal.
According to the KCanG, propagation material is actually exempt from the prohibitions. The defense therefore argued that the case undermines the right to home cultivation and constructs a criminal accusation. The court did not follow this reasoning. Saidi sees the ruling as evidence of a fundamental conflict in the interpretation of the new law. Supporters protested outside the courthouse against what they consider ongoing criminalization of educational work.
