Augsburg District Court orders confiscation of profits from illegal CBD trade
2026-02-24 | According to a report by Telespiegel, the District Court of Augsburg (case number 401 Ls 101 Js 123456/25) sentenced the 32-year-old operator of a CBD online platform to repay approximately €450,000. The court considers this amount to be the net profit from illegal transactions involving cannabis and CBD products, which generated total revenue of €650,000 from more than 22,000 orders within one and a half years. The convicted individual lacked the required narcotics-related license for trading, which is why the business was classified as criminal.
In addition to the confiscation of profits, a fine of €9,600 was imposed, while another participant must pay €900 to a charitable organization. The rulings are not yet legally binding.
The court clarified that the trade and distribution of cannabis remain strictly regulated and subject to authorization even after partial legalization in 2024. According to Section 4 of the Medical Cannabis Act (MedCanG), domestic trade still requires official authorization from the Federal Opium Agency. Sales without this concession constitute a violation of the Narcotics Act. While home cultivation of up to three plants and possession of 25 grams of dried cannabis for adults are not punishable, distribution to third parties or commercial sales without a license remain prohibited.
