Nearly a decade after Massachusetts voters legalized adult-use cannabis, the Massachusetts Cannabis Control Commission’s final Social Consumption Establishment regulations took effect, making Massachusetts the only state in New England to permit regulated on-site cannabis consumption venues.

The regulations are now in place but Social Consumption Establishment licenses are not yet available, and the road to licensure involves municipal opt-ins, a multi-phase Commission implementation process, and a 36-month exclusivity period that will shape who can apply and when.

At the same time, recently enacted legislation will bring substantial changes to the current medical and adult-use cannabis programs in the Bay State, including increased retail license caps, updated equity ownership thresholds, clarified delivery and advertising rules, and new transaction restrictions for delinquent licensees.
