Bavarian Higher Regional Court: Online Platform Prescriptions Do Not Protect Cannabis Consumers from Driving Bans
2026-07-30 | According to a ruling by the Bavarian Higher Regional Court (Case No. 201 ObOWi 401/26), cannabis prescriptions issued via online platforms such as Dr. Ansay do not automatically qualify for the medication exemption under German road traffic law, as reported by Pharmazeutische Zeitung and Apotheke Adhoc.
A driver unsuccessfully appealed a traffic fine because the online prescriptions submitted did not contain clear, day-specific dosage instructions. Consequently, despite possessing a private prescription, the offence of driving under the influence remained valid.
