2026-08-16 | According to attorney Simone Fischer, the Federal Court of Justice (BGH) has ruled that referral platforms for medical cannabis violate the ban on advertising to the general public under Section 10 of the German Medicines Advertising Act when they specifically generate treatment requests through lists of medical complaints. The Düsseldorf Regional Court (LG Düsseldorf) reportedly extended this assessment to purely online ordering models without genuine physician contact and also established potential joint liability for cooperating pharmacies. For patients, this could create legal risks: while protection may still exist in fine proceedings where a physician independently prescribed the treatment, insufficiently documented treatment could lead to the loss of a driving licence under driving licence law.
