VG Cologne: Sale of Potted Cannabis Cuttings Prohibited
2025-11-20 | The Administrative Court of Cologne (VG Köln) ruled that the commercial sale of potted cannabis seedlings violates the KCanG and may be immediately prohibited, reports beck-aktuell.
A retailer’s emergency request, who had generated six-figure revenues from selling rooted cuttings, was unsuccessful.
The court held that a planted and rooted young plant counts as cannabis under § 1 No. 8 KCanG, regardless of developmental stage. The KCanG exception for propagation material applies only to unplanted cuttings or seeds. The KCanG is intended solely for non-commercial reorganization of the cannabis sector; commercial trade in seedlings would undermine the legal framework. Public interest in youth protection outweighs the retailer’s economic concerns.
