The legal case involving a Mi’kmaq man charged with selling cannabis without a licence will now move forward to a constitutional challenge, reports The Canadian Press.
Durfee has challenged provincial enforcement following raids connected to his operations. A provincial court judge has said that his treaty rights are not to be considered at the initial stage of the proceedings, and that court dates for his constitutional challenge will be set on April 10.
Durfee, a member of Millbrook First Nation, argues that he has a legal right to sell cannabis at treaty truckhouses—a term for trading posts established in treaties signed by the Mi’kmaq and British Crown in the 1700s.
