ROANOKE, Va. (WFXR) – Hemp business owners across Virginia waited patiently inside the Reuben Lawson Federal Building, hoping for an injunction to pause new hemp regulations signed into law by Governor Abigail Spanberger at the end of June.
Everyone will have to wait a little longer, as the federal judge said he still needs time to make a decision.
“I am still not going to be able to get any sleep until we hear what the judge has got to say,” Cody Moorefield, the co-owner of Simply Hemp in Collinsville, said. “Don’t know when the ruling will come in, hopefully pretty soon, but until then, we’re still up in the air.”
The state classifies hemp as any product with less than 0.3 percent of the total THC concentration. THC is the chemical that produces a high. Consumable hemp products in Virginia must be limited to two milligrams of THC.
There is currently an exception allowing products to be sold as long as they have a 25:1 CBD-to-THC ratio. On Saturday, that exception is set to disappear, putting the cap on all products at two milligrams.
All other products will be viewed as marijuana products, which is illegal to sell without a business license. Penalties can range anywhere from a small fine to jail time depending on how much illegal product is involved.
