German Government Confirms Legal Distinction Between Medical and Adult-Use Cannabis in Road Traffic Law


Responding to a parliamentary question submitted by MP Ates Gürpinar (The Left), State Secretary Christoph de Vries confirmed that German authorities apply separate legal frameworks for recreational cannabis (KCanG) and medical cannabis (MedCanG).

While the general legal THC blood serum limit of 3.5 ng/ml applies in road traffic, this administrative offence does not apply under Section 24a (4) of the Road Traffic Act when cannabis is consumed as prescribed medical treatment.
