2024-11-12 | Lawyer Peter Homberg (Dentons), who specializes in cannabis, believes that a complete repeal of the Cannabis Act (CanG) is unlikely, even if the CDU were to lead the next German government, he made clear in an interview with KrautInvest. A “180-degree turnaround” in cannabis policy would be difficult to implement, especially as cultivation associations are already licensed for seven years.
Homberg assumes that there will be grandfathering for already licensed clubs. However, he could imagine that the law could be restricted to a certain extent, for example with regard to the permitted quantities for carrying and storing. The administrative hurdles for cultivation associations could also possibly be increased further.
With regard to medicinal cannabis, Homberg does not expect it to be reclassified as a narcotic. He assumes that it will remain a prescription-only drug, especially since a liberalization for people with statutory health insurance was recently decided.
