Criminal investigation against Homburg physician over cannabis prescriptions
2025-12-22 | The Saarbrücken public prosecutor’s office has initiated criminal proceedings against physician Sven Gottschling on suspicion of breach of trust to the detriment of statutory health insurance, according to Die Rheinpfalz. As Senior Public Prosecutor Thomas Schardt stated, a preliminary review procedure initiated in mid-June revealed sufficient initial suspicion against the doctor employed at Homburg University Hospital. The physician is accused of having prescribed medical cannabis flowers to a patient over several years until autumn 2023 in quantities in the low double-digit kilogram range. According to the authorities, these prescriptions were allegedly neither medically indicated in terms of quantity nor form of administration, leading to unjustified reimbursements by the health insurance fund.
In parallel, an investigation is being conducted against one of Gottschling’s patients on suspicion of aiding and abetting. The public prosecutor’s office emphasized that investigations are ongoing and that the presumption of innocence applies until a final conviction. The final determination of criminal liability lies solely with the courts.
Gottschling had appeared publicly at the beginning of the year in Zweibrücken when he proposed to the city the opening of a specialist shop for the legal acquisition of cannabis. The project triggered controversial debates in the city council, after which the physician withdrew his proposal in June.
