Germany: Test case: Hemp association supports lawsuit against Bavarian blockade of cannabis clubs

2026-06-03 | The German Hemp Association (DHV) is financing a lawsuit by the CSC Inntal e.V. against the refusal of building permission in Bavaria in order to obtain a fundamental clarification of the building law classification of cultivation associations, according to a press release by the association. Although the association already holds an agricultural permit, actual hemp cultivation is being blocked by state building regulations. According to the Free State, cannabis cultivation associations are only permitted in special zones, which in practice do not exist in Bavaria. The Hemp Association accuses the CSU-led government of deliberately undermining federal law through this restrictive interpretation and preventing a legal alternative to the black market. In addition to this test case, the DHV is supporting further lawsuits, including one against the consumption ban in Munich parks and an ongoing popular action before the Bavarian Constitutional Court against the Cannabis Impact Limitation Act.
