  • Use E-Verify to make sure employees are eligible as per government regulations.

  • Keep audit-ready employment records.

It’s the little details that make or break being on the right or wrong side of the law. Weak compliance can compromise state licenses. Also crucial to remember is that an audit can happen at any time. Failing to prepare means preparing to fail.

Although insurance doesn’t cover illegal actions or crimes, it’s a powerful lifeline when enforcement strikes. Cannabis insurance coverage includes important guardrails that act as excellent safety nets for businesses in difficult times.

  • Employment Practices Liability (EPLI): Handles disputes over hiring, firing, or eligibility claims.

  • Directors & Officers (D&O): Shields leadership from accusations of failed compliance management.

  • Business Interruption: Replaces revenue lost when facilities or shops are temporarily closed.

Insurance works best when it’s paired with proactive compliance, trained staff, and clear protocols for real scenarios. However, keep in mind that not every insurer will have the know-how of cannabis. That’s why it’s crucial to seek out an insurer that specializes in cannabis insurance.

While companies can’t control enforcement, they can take charge of preparation. That means:

  • Auditing files, checking every I-9 form and employment record is up to date and correct.

  • Train teams—managers must be well-versed in verifying employees’ records.

  • Get the right legal advice from lawyers familiar with both cannabis and immigration law.

  • Check insurance coverage includes EPLI, D&O, and business interruption.

  • Set a response plan in place, which includes defined communication protocols, legal contacts, and insurance notification procedures.

These steps are designed to cover most, if not all bases, ensuring companies are as prepared as possible.

Immigration raids aren’t a far-off threat, but a very real risk to cannabis operators. In an industry that relies on manual labor and is tackling regulatory friction, the stakes are extremely high. Not having a fallback in the form of customized protection leaves operators, including their staff and leadership, incredibly vulnerable to personal liability.

Immigration enforcement has also impacted other industries, such as agriculture, food processing, and construction, for similar reasons to cannabis.

The bottom line is that companies that fail to implement compliance systems or insurance tend to collapse.
