Malaysia: College lecturer charged with possessing over 200g of cannabis, ” punishable under Section 39A(2) of the same act, carries life imprisonment or a minimum of five years’ jail and at least 10 strokes of the cane.”

MELAKA: A vocational college lecturer was charged in the Ayer Keroh Sessions Court today with three counts of possessing 204.75g of cannabis.

Rosmainy Gulam Mohd, 48, pleaded not guilty to all charges before judge Rohatul Akmar Abdullah.

Under the first charge, he is accused of possessing 175.09g of cannabis.

The offence, framed under Section 12(2) of the Dangerous Drugs Act (DDA) 1952 and punishable under Section 39A(2) of the same act, carries life imprisonment or a minimum of five years’ jail and at least 10 strokes of the cane.

For the second charge, he is accused of possessing 24.42g of cannabis, an offence under Section 12(2) of the DDA 1952 and punishable under Section 39A(1) of the same act. This provides for a jail term of between two and five years and three to nine strokes of the cane.

Rosmainy, who was unrepresented, also faced a third charge under Section 6 of the DDA 1952 for possessing 5.24g of cannabis. This carries a maximum fine of RM20,000, a jail term of up to five years, or both.

The offences were allegedly committed at a house in Taman Duyong Ria, Duyong, at 11.30pm on Feb 12.

Deputy public prosecutor Rifah Izzati Abdul Mutalif requested a new mention date to obtain the chemist’s report on the exact weight of the drugs and did not offer bail.

The court fixed April 10 for mention, submission of documents, and the appointment of a lawyer.
