“I applaud the newly proposed policy by CMS and the support from the Trump administration to allow cannabidiol (CBD), derived from federally legal hemp, to be covered under certain Medicare programs.

This proposed shift represents a meaningful step forward in recognizing hemp-derived CBD products as a legitimate therapeutic option for seniors and other Medicare beneficiaries.

From a regulatory, compliance, and industry perspective, it acknowledges what many who work across the hemp and medical cannabis sectors have argued for years: that responsible, legally compliant access can and should coexist with public health, medical oversight, and consumer safety. This is truly a step in the right direction and hopefully is just the beginning of further steps to legitimize these industries and legalize the therapeutic uses of plant medicines.

We believe this proposal, if finalized, will provide seniors with new, non-opioid alternatives for wellness and palliative care, and will offer much-needed legitimacy and stability to the industry, especially after recent federal developments on the federal level. The industry seeks to be regulated not banned to provide the benefits of the plant to those in need.

The proposed rule would amend regulations, which currently state that any “cannabis products” cannot be covered by Medicare. The new policy would prevent coverage for only “cannabis products that are illegal under applicable state or federal law, including the Federal Food, Drug, and Cosmetic Act.”

As the rule moves forward through the rulemaking process, we encourage all interested parties to support the change as this truly is a step in the right direction to provide access to alternative medicines to those in need.”
