In 2020, Oregon became to first state to legalize psilocybin for therapeutic purposes through [Measure 109, which was approved by a 55.75% majority vote. Due to the passage of the Psilocybin Program Initiative, licensed service providers are allowed to prescribe psilocybin products to patients 21 or older. Under the Oregon Health Authority’s framework, there are four (4) types of available licenses: (1) Service Center; (2) Manufacturer; (3) Facilitator; and (4) Psilocybin Testing Laboratory. Per the Oregon Psilocybin Services’ spring newsletter, there have been 11 applications submitted for Service Center licenses, 16 applications submitted for Manufacturer license, 27 applications submitted for Facilitator licenses, and 2 applications submitted for Laboratory licenses. Presently, only 2 licenses have been awarded thus far.

Two years after the City of Denver decriminalized the use of psilocybin for adults 21 and older, the state of Colorado passed Proposition 122 in 2022 to legalize psychedelics, specifically psilocybin for therapeutic uses in mental healthcare. The appointed Natural Medicine Advisory Board will make its first recommendations by September 30th for regulatory oversight, so clinics can begin offering psilocybin by late 2024. Due to its more expansive legislation, Proposition 122 further allows officials to develop similar programs by 2026 for other psychedelic substances like DMT, ibogaine, and mescaline (excluding peyote).

Although Oregon and Colorado are the only “legalized” markets presently, several other states and cities are beginning to not only decriminalize the use of psilocybin, but also expanding their research initiatives. Washington DC has decriminalized its use, as well as several cities within Michigan, Massachusetts, and Washington. Further, numerous states have either passed or initiated bills to promote research into the medical and potential of psilocybin for a variety of conditions. Such states include: Arizona, Hawaii, Missouri, Montana, New Hampshire, New Jersey, Utah, and more!
