Press Release: Texas Hemp Industry Lawyers Share Insights on Hearing for a Permanent Injunction on Rules Banning Consumable Hemp Products 

 

What: Lawyers will provide a briefing on Monday, April 27, at 1:30 pm on the hearings that will determine if a permanent injunction will be granted in the lawsuit filed on behalf of leaders of the hemp industry against the Texas Department of State Health Services, Texas Health and Human Services Commission, and Texas Attorney General Ken Paxton. The judicial hearings begin at 9:00 a.m. on Tuesday, April 28, 2026, in Austin, Texas.

The lawsuit alleges that new administrative rules bypass the Texas Legislature to illegally restrict the sale and manufacture of consumable hemp products (CHPs). A Temporary Restraining Order was granted on Friday, April 10, 2026, to stop the enforcement of the administrative rules.

Background: The lawsuit was filed by a coalition of Texas hemp business leaders and advocacy groups against the Texas Department of State Health Services (DSHS), the Texas Health and Human Services Commission (HHSC) and Texas Attorney General Ken Paxton alleging that new administrative rules (which are currently under a Temporary Restraining Order issued on Friday, April 10, 2026) bypass the Texas Legislature to illegally restrict the sale and manufacture of consumable hemp products (CHPs).

The plaintiffs—including the Texas Hemp Business Council (THBC), Hemp Industry & Farmers of America (HIFA), and several Texas-based dispensaries and manufacturers—argue that the state agencies have overstepped their constitutional authority by rewriting statutory definitions that were previously established by the Texas Legislature in 2019.
