The Natural Medicine Division (Division) is issuing this Industry Bulletin to highlight information shared in the April 22nd permanent rulemaking hearing. The Division has seen a number of communications misrepresenting the DOR’s position regarding whether licensees are permitted to sell regulated natural medicine under the Natural Medicine Code, at sections 44-50-101, et seq.,C.R.S. (Code), and Natural Medicine Rules, at 1 CCR 213-1 (Rules).
The two main reminders in the Bulletin:
- Under the Code and Rules, licensees are not permitted to use an unlicensed entity to transfer regulated natural medicine to participants.
- The law prohibits the sale of regulated natural medicine to participants as a separate transaction.
