South Africa: Josh Swart: Nobody Wins by Criminalizing Private Cannabis Clubs So Here Are the Options (Cannabiz Africa)

Government should consider bringing out a Private Cannabis Clubs Act to clear up the legal mess it has created around the model, which clearly has a place in the reform framework. Lawyer Josh Swart says that legitimate clubs should be regulated without the threat of criminal sanction and puts these options on the table.

Swart, a Stellenbosch law graduate himself, says private cannabis clubs fall outside the current regulatory framework and that it is up to the Department of Justice to provide clarity or risk a continuing breakdown of law and order.

He said there were three immediate options available to the Department:

1.       Create a section in the regulations of the Cannabis for Private Purposes Act that recognized and regulate the private club model system;

2.       Draft a completely new Cannabis Private Clubs Act that provided a legal non-commercial framework for them to exist in.

3.       Draw up an entirely new Cannabis for Commercial Purposes Act that dealt with all aspects of cannabis, including the licensing and regulation of private clubs
