South Africa: “The Cannabis for Private Purposes Act No 7 of 2024 has been rendered obsolete by market reality”

SA’s first dedicated cannabis law is to set to come into force with final regulations due before year-end. However, no matter what the details are, the Cannabis for Private Purposes Act No 7 of 2024 has been rendered obsolete by market reality.  It’s intention was to restrict access to cannabis, while the DTIC is trying to devise a policy to open up access. The imminent ‘operationalization’ of the Act will be  a policy setback for Government, criminalizing the intended beneficiaries of the National Cannabis Master Plan and complicating the DTIC’s reform strategy by expressly outlawing all commercial cannabis trade. And, oh yes, it’s unconstitutional, so it will be challenged in court the moment it becomes law!  El vacuo continua!
