Based on stakeholder feedback during the August 5, 2026, stakeholder meeting, the Marijuana Enforcement Division (Division) is publishing updated draft rule revisions.
These revisions address some of the topics raised on August 5th and through written comment, including:
- Replacing references to “wet whole plant” with “fresh frozen” to align with DOR Division of Taxation rules – throughout the rules;
- Licensed Premises diagram requirements – Rule 3-205 (page 143);
- Testing Facility rejection of Test Batches – Rule 3-605 (page 206), 5-410 (page 411), 6-410 (page 530);
- Creation & Repackaging of Production Batches – Rule 3-805 (pages 229-230);
- Research and development testing – Rule 4-220 (page 313);
- Subletting, subleasing, and contracting restrictions – Rules 5-115 (pages 351-352), 5-210 (pages 362-363 ), 5-310 (pages 387-388), 6-110 (pages 473-474), 6-210 (pages 481-482), 6-310 (pages 506-507).

Please note, these updated draft rule revisions are not final and may be further revised and updated prior to August 19, when the Division will publish the final draft rule revisions and prior to submitting final proposed rule revisions to the State Licensing Authority. We are sharing this updated draft to allow stakeholders additional time to review and provide feedback.
The complete set of draft rule revisions will be released in advance of the permanent hearing on August 26. Written rule comments can be submitted to the Division using the written comment form, and you can find all rulemaking resources and information on our website.
