NORWALK — A North Fairfield man is facing a five-count indictment.
Donald J. Davis, 35, of the 1400 block of Rome Greenwich Road, is facing charges of illegal manufacture of drugs, a first-degree felony; aggravated drug trafficking, a second-degree felony; aggravated drug possession, a third-degree felony; child endangering, a third-degree felony; and possessing criminal tools, a fifth-degree felony.
Davis is accused of producing and selling Psilocin, which is a compound found in magic mushrooms. Psilocin is a schedule one controlled substance. It is in the same category as heroin, MDMA and LSD.
The indictment also has forfeiture specifications. That means the state is seeking to keep property that they allege was used in a criminal enterprise.
Items specified for forfeiture include: numerous cellphones, a tablet, digital scales, mason jars, baggies, a mirror, a grow tent, grinders, shipping envelopes and syringes. The state is also seeking to keep $15 in cash.
The charges arose after Huron County deputies executed a search warrant at Davis’ home on Feb. 25. They seized numerous items.
In April, Davis filed a civil suit against the Huron County Sheriff’s Office. He alleged he was given a receipt for items seized during the raid but the receipt did not account for everything that was taken.
He claimed that some of the items taken could not reasonably be determined to be contraband, such as “lawfully prescribed medication and personal property belonging to a minor child,” the complaint states.
All future proceedings in the civil case are on hold pending the outcome of the criminal case.
Davis pleaded not guilty to the indictment. He has a pre-trial hearing scheduled for 1 p.m. on July 27.
As of late Tuesday, he is held in Huron County Jail under a $20,000 bond. If released, he is to have no contact with his minor child.
