In the Court of Appeal of the State of California, Third Appellate District (Sacramento), Sacramento Municipal Utility District (SMUD) has filed a lawsuit against David Kwan. The case, identified as C097382 and dated April 30, 2024, pertains to power theft allegations in support of a cannabis grow operation.
The lawsuit alleges that SMUD opened an electrical service account for Kwan, which was later found to be diverting power for a cannabis operation. Represented by Quinn Covarrubias, George E. Murphy, Stephanie L. Quinn; and Randall J. Hakes, SMUD accused Kwan of aiding and abetting utility diversion and won treble damages plus attorney fees at the Superior Court of Sacramento County presided over by Judge Kenneth C. Mennemeier Jr.
Kwan’s defense, led by Stephanie J. Finelli from Law Office of Stephanie J. Finelli, argues that there is insufficient evidence to prove his knowledge of the power theft and challenges the monetary awards.
SMUD seeks affirmation on the judgment made by the Superior Court regarding Kwan’s liability for aiding and abetting utility diversion and the awarded treble damages plus attorney fees.
