Publishing 1 February 2025: ” Legalizing Cannabis Extracts – A Journey To The Supreme Court of Canada”

Author, Owen Smith writes on Linked In

Did you know Canada’s Supreme Court once compared recreational cannabis to cannibalism?

When the Supreme Court ruled in favor of medicinal cannabis, it was a unanimous decision. But when the Court ruled on recreational cannabis in 2003, the outcome was quite different.

The Court rejected the idea that cannabis could be equated with recreational activities like golf. Instead, they used the comparison to illustrate that the absence of direct harm does not automatically make an activity lawful.

Societal norms and ethical considerations, they argued, play a significant role in shaping the law.

While they compared cannabis to golf, we compared a trichome to a golf ball on a tee.

Find out why we won the most significant cannabis ruling in Canadian history by reading the detailed account in my book, Legalizing Cannabis Extracts: Edibles in the Supreme Court of Canada.

Owen, Ted and the crew of the Victoria Cannabis Buyers Club embark on a David versus Goliath showdown with Health Canada and the Harper Conservative government.

This case established the most significant cannabis ruling in Canadian history, while at the same time discovering a new means of legalizing a psychoactive compound outside of the powers of government and the drug approval process.
