Alert: Comments on Regulated Natural Medicine Program rules

Dear Interested Parties:

Thank you to those of you who provided feedback on the initial Regulated Natural Medicine Program rules. The Natural Medicine Division appreciates your engagement and participation, which informed the final rules. On Friday, Aug. 9, the State Licensing Authority adopted and filed the final rules with the Secretary of State. The final adopted rules are linked on the Division’s Rulemaking page and are available in our public resources folder.

 

The implementation work continues! We are now shifting to focus on fee setting. As directed by the Natural Medicine Code, the State Licensing Authority must adopt application and license fees covering the direct and indirect costs of administering the Regulated Natural Medicine Program. For initial fee setting, the Division will look to the final adopted rules to inform the scope of work required to license and regulate Natural Medicine Businesses, and carry out other duties and responsibilities as directed by the Code. We filed the Notice of Rulemaking with the Secretary of State on August 15, 2024. The Notice and proposed fees are available in the public resources folder and on the Division’s Rulemaking webpage.

The Division will hold a public stakeholder meeting on Wednesday, Aug. 28, 2024, from 3 p.m. to 5 p.m. We will post the agenda, draft rules, and any other materials the week before the meeting. The final hearing will be held on Monday, Sept. 16, 2024 at 2 p.m.

The initially proposed fees reflect the Division’s intent to create a lower barrier to entry for those applying in the first year of the program, followed by a ramping up of fees in years 2 and 3 of the program. These initial application fees at a lower cost would only be available to applicants for the first 12 months of the program.

The estimated participant population and target licensee population are informed by the scope of participation in Oregon’s Psilocybin Services Program and responses to the Participant Interest Survey. Based on the information gathered so far, the Division is proposing conservative projections for the number of applicants who will apply for and obtain Owner, Natural Medicine Handler, and Natural Medicine Business licenses; however, as we prepare to accept license applications starting Dec. 31, 2024, we will be using surveys, written comments, and stakeholder forums to gather additional feedback from stakeholders to further develop these projections, compliance tools, future rule updates, and other ways the Division can support potential applicants and licensees.
