Formal Rulemaking Notice

Today, per the Maine Administrative Procedure Act (MAPA), the Office of Cannabis Policy (OCP) is starting the process of formally engaging in major substantive and routine technical rulemaking to implement public laws passed in the First Regular and Special Sessions of the 131st Legislature, as well as incorporating guidance previously issued by OCP and reorganizing the rules to make them easier to navigate. These changes implement laws about delivery, returns, marketing and advertising, as well as the requirements for specified event permits.

In order to implement these new laws effectively and help the public better navigate the rulemaking process, it is important to note that the adult use program rules have been reorganized. The updated chapters include Chapter 10 (Rules for the Administration of the Adult Use Cannabis Program, 18-691 CMR, ch. 10), Chapter 20 (Rules for the Licensure of Adult Use Cannabis Establishments, 18-691 CMR, ch. 20), Chapter 30 (Compliance Rules for the Licensure of Adult Use Cannabis Establishments, 18-691 CMR, ch. 30), and Chapter 40 (Rules for the Testing of Adult Use Cannabis, 18-691 CMR, ch. 40).

We invite you to review Chapters 10, 20, 30, and 40 in the program rule and provide your written feedback. A copy of the proposed rules and public comment forms (one for each chapter) can be found on the OCP website.

We ask that you ensure you are commenting on the correct chapter and form and ask that you be specific in your comments. OCP will accept comments starting today, August 15 through September 17, 2023, at 11:59 p.m.

Public participation is a critical component of the MAPA process. As such, OCP is also holding an in-person public hearing on September 6th to take public comments and questions.

Either or both avenues may be utilized by interested members of the public to provide feedback to OCP on the format, content, and/or application of the proposed rules.

Once the public comment process is complete, OCP will consider the feedback received and make appropriate revisions to each rule. Following these revisions, OCP will finally adopt the routine technical rules (Chapter 40) and submit the provisionally adopted major substantive rules (Chapters 10, 20, and 30) for legislative consideration before final adoption.
