German Courts Are Saying Nein To Cannabis Advertising

Court prohibits consumer advertising for medicinal cannabis

2025-03-07 | The Frankfurt Higher Regional Court has ruled that advertising for treatments with medicinal cannabis violates the Therapeutic Products Advertising Act. The former platform AlgeaCare from Bloomwell GmbH promised free cannabis treatments on prescription and specifically steered patients towards a prescription, reports the ÄrzteZeitung. According to the court, this is inadmissible product-related advertising for a prescription-only medicine. In addition, a “cooperation doctor” had paid hidden commissions. Court stops cannabis advertising by DrAnsay

2025-03-11 | The Hamburg Regional Court has issued a temporary injunction against the platform DrAnsay and its operator Can Ansay at the request of the North Rhine Chamber of Pharmacists, reports apotheke-adhoc. According to the court, the advertising for online cannabis prescriptions violated the German Therapeutic Products Advertising Act, as advertising to the public is not permitted for telemedical treatments and prescription drugs. In addition, personal contact with a doctor is required for medicinal cannabis due to possible health risks. The decision could have far-reaching consequences for similar providers.
