Upon request, the Federal Ministry of Finance informed the German Cannabis Business Association (BvCW) that the supply of cannabis to members of growers’ associations in return for cost allocation is subject to VAT. This would mean that VAT of 19% would have to be added to the price for this distribution by non-commercial growers’ associations. The Federal Working Group Cannabis Cultivation Associations (BCAv) does not share this legal opinion and would like to support a lawsuit against this. We are therefore looking for a growers’ association that will be selling cannabis in 2024 and would be prepared to take legal action against this. The costs for this would be covered by the BCAv, for example with the help of a crowdfunding appeal. Interested growers’ associations should contact BCAv coordinator Heinrich Wieker.
