Important Rulemaking Alert: Department of Cannabis Control Provides Notice of Emergency Regulatory Action

Notice of proposed rulemaking to adopt emergency regulations for cultivation license changes at the time of renewal pursuant to Business and Professions Code section 26061.5 

The Department of Cannabis Control (DCC) is providing notice to the public of its intent to adopt its emergency regulations implementing Senate Bill 833, codified in Business and Professions Code section 26061.5, which requires the DCC to allow cultivation licensees to make certain changes at the time of renewal, including: change the type of size of a cultivation license; place a cultivation license in inactive status; or make a one-time change to a cultivation license’s date of renewal.

DCC will file the emergency package with the Office of Administrative Law (OAL) after the required five-working day notice to the public. The public comment period, which lasts five-calendar days, will begin when OAL publishes the proposed regulations as being “under review” on the OAL website.

DCC will share instructions for submitting a public comment and participating in the regulatory process when the comment period opens. Please note that only comments received during the public comment period must be considered.
