Pennsylvania Medical Marijuana: Commonwealth Court’s Cannabis

The Pennsylvania Commonwealth Court was established in 1968 to hear cases involving state and local governments and state agencies. It possesses original jurisdiction for cases filed against the Commonwealth of Pennsylvania and may hear cases filed by the Commonwealth. It also acts as an appellate court with respect to a wide variety of matters, including cases to which the Commonwealth (or a local subdivision thereof) is a party, appeals of decisions by Commonwealth agencies, cases involving the operation of nonprofit companies and election disputes.

Pennsylvania Medical Marijuana: Turning Over on Leaf

In early April, Pennsylvania’s Medical Marijuana Advisory Board (Board) delivered a report to the Department of Health (DOH) recommending changes to the medical marijuana program. Among the proposed reforms – recognizing additional medical conditions as cannabis-treatable (neurodegenerative diseases, dyskinetic and spastic movement disorders, opioid addiction treatment and terminal illness), allowing physicians to opt out of DOH’s public registry, and allowing licensed dispensaries to sell cannabis in dry leaf and flower form.

Pennsylvania Medical Marijuana: Lessons Learned

On March 23, 2018, the New Jersey Department of Health (DOH) released a review of the state’s eight-year-old medical marijuana program in its Executive Order No. 6 Report (Report). On March 27, New Jersey Governor Phil Murphy announced that many of the DOH’s wide-ranging recommendations would be implemented immediately. Additional recommendations will be explored through legislative and regulatory procedures.

The inclusion of Chapter 20 in the MMA advances the Commonwealth’s goal of clinically studying the uses of cannabis as a medical treatment.
