A Nebraska attorney can invest in a medical marijuana business in South Dakota because the investment wouldn’t violate state law or ethical rules, a Nebraska ethics committee said in a recent advisory opinion.
The question submitted to the group presents a thorny issue, given the patchwork of state and federal laws regarding the legality of marijuana use for medical or recreational purposes.
Marijuana use is illegal in Nebraska and under federal law, but South Dakota and 36 other states allow its use for medical purpose. Marijuana is legal for recreational purposes in 18 states.
