The US laws and interpretations of what is defined as cannabis, hemp, and marijuana conflict and are vague or overspecified, leading to numerous confusing products and markets. The laws could be called crazy, nuts, or bananas – which is a simple analogy to understand the product differences.

Imagine a world where bananas are illegal.

but only the yellow ones…

Then some states pass laws regulating licensed production and distribution of bananas. Though US Federal law says they are still illegal, the Feds largely tolerate state licensed actors (though tax them like criminals). All state-licensed bananas must be grown and consumed in the same state (no legal interstate commerce), but there are still lots of illicit banana operators.

Then the Federal Government redefines only yellow bananas as illegal, and many argue that everything else banana-like is now Federally legal.

The 2018 Farm Bill aimed to legalize plantains for industrial use, but many argue the law is worded in a way that makes green bananas federally legal too, and that testing a banana when it is green makes it legally “green” forever – even if it later turns yellow.

While some plantains and bananas will never taste ripe, peeling some green bananas turns them yellow immediately and they taste ripe to the end consumer.

Because the banana tested as “green” 30 days before harvest are legally green forever, these green bananas can be sold online, be shipped across the country in the US mail, take credit cards for payment, pay normal taxes, and many states allow them to be sold in any distribution point without any regulatory oversight – and turn yellow and ripe when peeled by the end consumer.

Some green bananas are high quality, and are even better than many state licensed yellow bananas. But some are not, with some labs testing yellow bananas and lying that they are green, and few are tested for contamination like pesticides or mold.
