USA-PA: Police Denied Immunity Over Suspect Who Died From Eating Cocaine

Harrisburg, Pa., law enforcement officers aren’t entitled to qualified immunity from a failure to render medical care claim brought against them by the estate of a suspect who died after ingesting cocaine to hide it from them, the Third Circuit said.

The right to medical care for persons in custody of law enforcement was clearly established in 2019, but neither the Third Circuit nor the US Supreme Court has recognized “the right to medical care after the ingestion of drugs,” the opinion by Judge Jane R.
